授業の概要　Course Overview

知的財産法は日本の産業や文化の発展を目的とする法律であることから、この学習を通じて、本学のMission Statementである「ビジネス界や社会の発展をもたらす知識の創出」の基礎を獲得することができる。
Since intellectual property law is laws that aim to develop Japanese industry and culture, through this study, students can acquire the foundation of the University's Mission Statement, "creation of knowledge that advances business and society".

授業の目的（意義） / Importance of this course

知的財産法と呼ばれる法分野には、特許法、著作権法、商標法、意匠法、不正競争防止法等の様々な法律がある。本授業では、これらの法律を学習し、知的財産法の基本的な枠組を理解する。
The field of law known as intellectual property law includes various laws such as Patent Act, Copyright Act, etc. In this class, students study these acts to understand basic framework of intellectual property law.

この科目を学ぶことで、身の回りの知的財産を法的な視点から理解することができるようになる。

By studying this subject, students will be able to understand intellectual property around them from a legal perspective.

事前学修と事後学修の内容、レポート、課題に対するフィードバック方法　Pre- and Post-Course Learning, Report, Feedback methods

○準備学習
・予習は毎週３時間程度必要となる。教科書の関連箇所を読むとともに、事前配布のケースや資料に目を通すこと。さらに、毎週予習レポートを提出する必要がある。
・六法を持参する必要はないが、授業中何らかの形で条文にアクセスできるようにしておくこと。

○課題
予習レポートとは別に、特定のテーマに関するレポートの提出を求める。詳細については授業中に説明する。

○中央情報センター（図書館）の活用について
・予習やレポート作成のための資料収集に有用である。

・知的財産法で保護されるもの➀（特許と営業秘密、ブランドとドメイン名）

・知的財産の侵害となる場合①（特許侵害）

「これって同じ発明？」

・知的財産の侵害となる場合②（紛らわしいブランド、デザインの類似）

専門は、独占禁止法、競争法、競争政策。特に標準必須特許の権利行使と独占禁止法の関係について研究している。

（実務経験 Work experience）

2006年に公正取引委員会事務総局に入局し、入札談合や価格カルテルといった独占禁止法違反事件の調査や独占禁止法の改正などに従事。公正取引委員会競争政策研究センター研究員も兼務。2023年6月から現職。

In 2006, he joined the General Secretariat of the Japan Fair Trade Commission (JFTC), where he was involved in investigating cases of violation of the Antimonopoly Act, such as bid rigging and price-fixing cartels, and other violations of the Antimonopoly Act, as well as revisions to the Antimonopoly Act. He also serves as a researcher at the Competition Policy Research Center of the JFTC.
