日本国憲法は国民主権や基本的人権、国と国民の関係や統治機構といった現代社会の基盤を定めており、これらを学習することでビジネスや社会の発展のために必要な基礎的な知識を身につけることができます。また、基本的人権について学ぶことにより、リーダーに必要な倫理観も養います。
The Japanese constitution law stipulates fundamental aspect of modern society, such as democratic sovereignty, human rights and relation between a nation and people. Through studying constitution law, students can acquire basic knowledge necessary for the development of business and society. Also, by learning human rights, students can foster ethical views necessary for leaders.
授業の目的（意義） / Importance of this course
これから社会人・ビジネスパーソンとして働いていく、或いは選挙などを通じて日本の政治に参加していく皆さんにとって、憲法の定めている、国民主権や基本的人権、或いは立法・行政・司法という国家の仕組みに関する基礎的な理解を持っておくことは重要です。この科目を通じて、日本の憲法の基本（憲法総論、基本的人権、統治機構）について学習します。
For anyone who will work in society or citizens who vote in elections, it is important to have basic understanding of human rights, democracy and governing systems of a nation (i.e., legislative, executive and judicial) which are stipulated by constitution law. Through this course, students will study basics of Japanese constitution law, including issues listed above.

学生が、現代において認められている憲法上の基本的人権としてどのような種類の権利があるかを理解し、他の人に対して説明や議論ができるようになる。また、国民主権や、立法・行政・司法という国家の基本的な仕組みを理解する。
Students are expected to understand main types of human rights under constitution law, and also expected to acquire ability to explain to or discuss with other persons on those issues. Further, students are expected to understand democratic sovereignty and basic structure of governing systems of a nation.

各回200分の授業に対し、200分程度の予習及び200分程度の復習をしてください。
詳細はイントロダクションの回に説明するとともに、各回には次の回に向けた個別の対象判例などを指示しますが、予習としては教科書で対象の節について学習するとともに、判例の事案の事実関係や裁判所の判示内容を読んでおいてください。また、ケースの使用がある回についてはそのケースも読んできてください。
復習としては、授業を踏まえて教科書の対象節や判例を確認するとともに、ケースでの議論を振り返ってください。ケースの議論後の追加の考えや質問などの簡単なレポート提出の機会を予定しており、クラス全体の議論に有益な議論や質問は授業の中で紹介します。
中央情報センター（図書館）も積極的に活用してください。

- ケースメソッド教育の中核は、積極的な参加と知識の共有です。この教育を支えるため参加者は授業中の電子機器（例：スマートフォン、ノートパソコン）の使用を制限するよう求められます。許可を得た場合でも、教室内では電子機器は、ケース討議に資する目的でのみ使用してください。授業中は、たとえケース討議に関連していても、検索エンジンや生成AIの使用は避けて下さい。

- Active participation and shared learning is at the core of the case method learning.Participants are asked to limit their use of electronic devices (e.g., laptops, smartphones) during classroom sessions in support of this model. Dr. Kenji Kawahara specializes in antitrust/competition law. His main research interest is antitrust/competition law issues over unilateral conducts by businesses with market powers including digital platforms (big-techs) .
He holds an LL.B. from University of Tokyo, a J.D. from University of Tokyo, an LL.M. from Georgetown University, and a Ph.D. in law from Kobe University.

法律事務所において、弁護士として独占禁止法・競争法分野の業務（カルテル等の違反被疑事件の対応、企業結合審査対応ほか）を、日本国内案件及び国際案件を含めて広く扱ってきたほか、競争環境に関わる行政側での法実務業務（電力・ガス分野、デジタルプラットフォーム分野（デジタルプラットフォーム取引透明化法の運用・執行））の経験を有する。

Before joining the Faculty of the NUCB in 2026, he had worked on antitrust/competition law area as an attorney in private practice (at Mori Hamada & Matsumoto (Japan), and Freshfields Bruckhaus Deringer LLP). Also, he had worked for governmental enforcer side governing energy sector (Electricity and Gas Market Surveillance Commission, METI, Japan) and big-techs (Digital Market Policy Office of Commerce and Information Policy Bureau, METI, Japan, enforcing the Digital Platforms Transparency Act.)
