授業の目的（意義） / Importance of this course

本講義では、日本国憲法に関する基本的知識を体系的に学習する。憲法とは、一言で表すと、「国の形」を規定する法である。日本という国がどういう「形」なのかという点について日本国憲法を通じて学ぶことは、現代の社会を理解する上で重要である。また、必要に応じて日本と外国の憲法との比較を行う。外国との比較によって、国際的な視点から日本がどういった形なのかをより明確にすることができる。これらの学習を通じて、本学のMission Statementに掲げられた世界的な視野を持った上で、国際的舞台で活躍していくために必要な基礎知識を身につけることができる。 なお、公務員試験を受験する学生は、憲法の学習が必須と言っても良い（専門試験だけでなく、教養科試験においても憲法はほぼ確実に出題される）。公務員試験受験を考えている学生にとっても有意義なものとなるように講義を展開する。
　　This class provides the basic knowledge of the Constitution of Japan. The constitutional Law stipulates the “Form of State”. For understanding the modern society, it is important to learn the form of Japan from the perspective of Constitution of Japan. This lecture also provides the international comparison of constitutional law. The point of view of international comparison makes the form of Japan clearer. Through these learning, students acquire the basic skills for succeeding in the international society with global perspective stated in the NUCB Mission Statement.

＜準備学習＞
　・毎回の講義に関しては、復習が重要となる。教科書や講義資料を活用して十分に復習を行うこと。
　・また、毎回の演習問題への取り組みが重要となる。また、演習問題は記述して持参すればコメントをつける。
　・疑問点があったら質問すること。オフィスアワーを利用しても構わないし、次の授業の前後でも構わない。また、メールでアポイントメントをとってもらえれば適宜対応する。疑問を疑問のまま放置しないことが重要である。

＜課題＞
　・中間レポートを提出してもらう。詳細は第初回講義で指示する。 レポートは採点して返却する。

＜中央情報センター（図書館）の活用について＞
　・レポート作成において活用してほしい。

第1日（Day1）

ガイダンス　―なぜ、憲法を学ぶのか？― 　
開講にあたって、講義の目標、進め方、学修方法を説明する。その上で、「なぜ、憲法を学ぶのか」という点について、憲法の役割と関連させながら説明する。

第2日（Day2）

国民主権と天皇制　―国民と天皇の関係はどう変化したのか？― 　
現代社会における私たち国民と天皇との関係について、「国民主権」と「象徴天皇」という観点から概説する。

第3日（Day3）

平和主義と日本国憲法第9条　―平和憲法の理想と現実とは？― 　
日本国憲法が掲げる「戦力不保持」という理想と、「自衛隊」という現実との関係について、戦後の日本の歴史や国際情勢と関連させながら概説する。

第4日（Day4）

基本的人権　総論　―人権は、誰に、どこまで保障されるのか？―
憲法の柱の一つである「基本的人権の尊重」という点について、その全体像を説明すると同時に、人権を制約する「公共の福祉」について概説する。

第5日（Day5）

精神的自由権　―言いたいとこは何でも言ってよいのか？―
私たちの内面や精神面に関係する「精神的自由権」と呼ばれる権利について、「信教の自由」と「表現の自由」を中心に概説する。

第6日（Day6）

統治機構　総論　―何故、権力分立が必要なのか？―
「権力分立」という観点から、立法、行政、司法という三つの権力のそれぞれの関係について概説する。
