授業の概要 Course Overview

本科目は、「新時代のアジアと世界をつなぐ能力」の育成に貢献する。本講義では、アジアにおける動向を、世界的な動向とあわせて、国際法の観点から理解するため、両者の関係について適切に把握する力が養われる。
This course will contribute to develop "the ability to bridge the gap between New Asia and the rest of the world" as this course learn about the movements both in Asia and the world through the lens of international law.
授業の目的（意義） / Importance of this course
本講義は、国際的にビジネスを行う上で重要となる「貿易」や「投資」に焦点を当てて、それらがどういうルールの下で行われているのかを理解する。学生は、それらの知識を教わるのではなく、自分が実際にビジネスに携わった場合にどのように判断するかを常に考えられる場を通じて学習することになる。
This course focuses on the issues related to "trade" and "investment" and understand how those activities are governed under the current international rules. Students are always required to think a question "what will you do when you are involved in a legal issues related to your business?"
到達目標 / Achievement Goal
まずは、国際ビジネスに関連する法的な知識の習得を目指す。また、国際関係における多様な人の考えに触れることを目指す。これらを通じて、自分が社会人として実際に働き出した場合に、国際ビジネスにおける様々な問題に冷静に対処することのできる人材となることを目標とする。
The prime purpose of the course is to obtain legal knowledge necessary when engaging in international business. The course will also try to know about the diversity in international relations. By learning these elements, students may become possible to calmly respond to the incidents that they may face during the international business.

第1日（Day1）
まずは、国際的なビジネスの前提となる「自由貿易」の仕組みについて学ぶ。その重要性と、それを積極的に推し進めることのできない要因について考え、自分の取るべき立場を考えられるようにする。●使用するケース
「自由貿易と抵抗勢力」（自作ケース）第2日（Day2）
自由貿易とあわせて重要な原則である「平等原則」について学ぶ。戦後の国際ビジネスにおいて平等原則が果たしてきた役割を知ると同時に、近年見られるその衰退について学び、社会の動向を読める能力を身につける。●使用するケース
「なかなか難しい平等待遇」（自作ケース）第3日（Day3）
自由貿易は重視される一方で、各国が正当な理由で貿易を制限することは認められても良いであろう。ではどのくらい認められるか？環境保護のため、労働者の保護のため、コロナ対策のため？どこまで認められるのが望ましいか、考える。●使用するケース
「ワクチンの輸出規制は認められる？」（自作ケース）第4日（Day4）
自由貿易を正当な理由がなくても制限したい時もあるかもしれない。そういう「わがまま」は許されるべきだろうか？もし条件付きで許されるとしたらどういう条件で許されるであろうか？学生同士の議論を通じて、多くの人の意見を学ぶ。●使用するケース
「貿易救済制度は必要悪？」（自作ケース）第5日（Day5）
WTO？TPP？RCEP？日英EPA？新聞を読むと貿易関係のこのような用語がたくさん出てくる。これらを理解することもさることながら、こんなに色々とある理由はなぜだろう？そのメリット・デメリットについて議論しながら学ぶ。●使用するケース
「重複するFTAたち。紐解けるか？？」（自作ケース）第6日（Day6）
外国に新しい工場や支社を作って、そこで生産するような仕組みを「投資」と言いますが、最近は、この投資が活発に行われるようになったぶん、トラブルも増えました。将来、皆さんも海外勤務がある可能性があるので、そのときはこの「投資」と強くかかわります。実際にどんなトラブルがありえて、どう対処すべきか？みんなで一緒に考えましょう。●使用するケース
「国の決定に外国の企業が文句？」（自作ケース）第7日（Day7）
新型コロナウィルス感染症は社会のデジタル化を加速させました。それに合わせて、デジタル貿易も一層広がると予想されるのですが、ことはそんなに簡単だろうか？デジタル貿易をめぐる問題点について勉強し、デジタル化時代に強い人間になろう。●使用するケース

担当教員のプロフィール About the Instructor
慶応義塾大学法学研究科博士課程、慶応義塾大学法学研究科助教（有期・研究奨励）、日本学術振興会・特別研究員（PD）、学習院大学や大宮法科大学院大学等の非常勤講師を経て、現職。 現在、内閣府・政府調達苦情検討委員会の委員も務める。主な研究分野としては、国際経済法の領域でも特に、「貿易と環境」、「対抗措置と比例性」、「WTOと自由貿易協定（FTA）の関係」等といったテーマの研究に取り組んでいる。
Takemasa SEKINE is an Associate Professor at Nagoya University of Commerce & Business (NUCB) in Japan. He received his legal education at Keio University, Japan (Ph.D. and LL.M) and was later engaged as a post-doctoral research fellow at the Japan Society for Promotion of Science (JSPS). He is currently a board member of the Government Procurement Review Board in Japan, and also joining research projects hosted by Japanese governmental institutions, such as the Ministry of Foreign Affairs of Japan and the Research Institute of Economy, Trade and Industry (RIETI).
