本講義は、Mission Statement の「ビジネス界や社会の発展をもたらす知識」の獲得に貢献する。適切に社会動向を把握することで、望ましいマネジメント力を養う。
This course may contribute to the development of "knowledge that advances business and society". Thorough the proper recognition of the social trend, students may develop a foundation for the management abilities addressing changes in the business environment.
授業の目的（意義） / Importance of this course
本講義では、企業をとりまく事象について、大局的な見地から理解し、それに対応する能力を養うことを目的とする。例えば、
・米国のバイデン政権の登場は、日米や米中の貿易関係にどのような影響を及ぼすか？それはどのような形で我々の生活に影響を及ぼすのだろうか？
・これから環境対策（温暖化対策）はどのように展開すると予想され、各企業はどのように対処することが求められるだろうか？
・新型コロナウィルス感染症を受けての各国の政策はグローバル・サプライ・チェーンにどのような影響を及ぼすであろうか？
などに代表される、企業の経営環境に大きな変化を与える事象が発生した場合への予見力と対処法（マネジメント能力）の向上を目指す。講義では極力、最新の情報を扱うこととし、変わりゆく社会に迅速かつ冷静に対応する力を養う。

The aim of this course is to understand, from the bird’s eye view, the phenomenon surrounding businesses, and to consider how we may manage such matters. The examples of phenomenon that will be focused in the course are:
・What kind of impacts would the UK’s decision to leave from the EU (Brexit), and its relationship with the EU, have on Japanese enterprises?
・How would the future environmental policy (global warming polity) shape like, and how should firms handle the environmental issues?
・How can Japanese government and domestic industries react when competing imports have surged?
Participants will seek to enhance the ability to predict the development of these events and learn how to cope with the issues (management abilities). The course will cast spotlights on latest events so that the participants can learn and try to resolve the problems that we may face in the real world.

第1に、経営環境に影響を与える外部的要素の基本的な仕組みを理解できる。第2に、それらの要素の最新の動向を理解することができる。第3に、それらの問題に対する対応を学生間で議論することにより、幅広いアイディアを学ぶことができる。
By the end of the course, you will be able to: (1) understand the process and mechanism of exogenous elements affecting businesses; (2) comprehend the recent actual movements of those elements; and (3) learn the diverse ideas to handle exogenous elements through the interactive learning among participants.

本講義の学習方法は基本的にケースメソッドに依拠し、ケースを分析した上での講義中の発言を主な成績評価の対象とします。
また、事前に読んでから講義に参加することが求められるケースについては、事前予習を行い、所定のものについてはレポート提出を課題とします。ケースの予習は1ケースあたり3時間が目安となります。
なお、最終テストは実施しません。

授業スケジュール Course Schedule
第1日（Day1）
●規制適合的な経営企業を経営していく上では、各種の規制や法令を遵守することが求められます。ここでは、景品表示法をはじめとした企業単位での経済活動と関連の深い法律との整合的な経営について考えます。＜ケース①、ケース②＞
●規制の変化とその対応
規制は常に一定とは限りません。規制の背景事情が変化するにつれ、規制も変化し、それに服する主体も変化しなければなりません。まずは、国内規制や情勢の変化に対してどのように対応するのが望ましいのか議論します。＜ケース③＞
●使用するケース
ケース①：「法規制に適合的な経営＜そんなことしてはいけません＞」、自作ケース②：「価格決定と外部的誘引＜あなたは誘惑に耐えられるか＞」、自作
ケース③：「環境規制の変化とその対応＜賢く温暖化対策がとれるか＞」、自作
第2日（Day2）
●国際情勢の変化とその対応続いて、日本国外での情勢の変化に対するマネジメントについて学びます。今年は、昨年来、新疆ウイグル自治区における強制労働問題に対する対処として米国やEUが取っている対応策（経済制裁）の内容、影響、採用すべき政策などについて検討し、その中で企業がどのように行動すべきかについて検討する土台を学びます。＜ケース④＞
●貿易環境の変化とその対応
最後に、企業が国際的なビジネスを展開する上で、直面するであろう国際的な経済問題を広く取り上げる予定です。具体的には、貿易救済制度、投資仲裁、コロナ感染症に対するワクチン政策、電子商取引などが時宜に適った論点と思われるので、これらを取り上げます＜ケース⑤、⑥＞

年度ごとにその時の国内外の事象を分析し、自らの行動のために考える講義は、毎年内容のアップデートが必要で大変ですが、最新情報に触れられるように工夫していきたいと思います。
担当教員のプロフィール About the Instructor
慶応義塾大学法学研究科博士課程、慶応義塾大学法学研究科助教（有期・研究奨励）、日本学術振興会・特別研究員（PD）、学習院大学や大宮法科大学院大学等の非常勤講師を経て、現職。 現在、内閣府・政府調達苦情検討委員会の委員も務める。主な研究分野としては、国際経済法の領域でも特に、「貿易と環境」、「対抗措置と比例性」、「WTOと自由貿易協定（FTA）の関係」等といったテーマの研究に取り組んでいる。
Takemasa SEKINE is an Associate Professor at Nagoya University of Commerce & Business (NUCB) in Japan. He received his legal education at Keio University, Japan (Ph.D. and LL.M) and was later engaged as a post-doctoral research fellow at the Japan Society for Promotion of Science (JSPS). He is currently a board member of the Government Procurement Review Board in Japan, and also joining research projects hosted by Japanese governmental institutions, such as the Ministry of Foreign Affairs of Japan and the Research Institute of Economy, Trade and Industry (RIETI).
